Subject Matter Experience

DOMESTIC – I have been an advocate, arbitrator and mediator in courts and arbitration tribunals within the U.S for more than 47 years. Subject matter has included general business, contract, construction, insurance coverage, reinsurance, insurance agent, business interruption and property loss, directors and officers liability, property and casualty, life/health and disability, professional liability and crop insurances; professional liability, securities, financial services, corporate finance, partnership and mergers and acquisitions, hospitality, business and consumer fraud, labor and employment, Qui Tam, False Claims Act, class action and personal injury disputes.

INTERNATIONAL – I have been an advocate and arbitrator in arbitration proceedings conducted around the world for more than 35 years. Subject matter has included investment treaty arbitration, international commercial arbitration, maritime insurance and reinsurance treaty disputes and general business, infrastructure, and financial services disputes under all the major international arbitration forums in Europe, Asia and North America.

A small but representative sample of cases and subject areas, in which I have served as arbitrator follows:

• Served as party-nominated arbitrator in international commercial dispute involving multi-national hotel operator administered by ICC.
• Served as party-nominated arbitrator in companion international commercial disputes involving the Brasilian Oil and Gas Industry administered by ICDR and LCIA.
• Served as President of Tribunal in international commercial dispute involving multinational manufacturer/distributor in Brasil administered by ICDR.
• Served as arbitrator in investment arbitration administered by ICSID, involving claims by Italian mining interests against the Government of the Republic of South Africa.
• Served as party-nominated arbitrator in dispute administered by ICC between Taiwanese corporation and U.S. based entertainment provider over landing rights for satellite transmissions into the country of Taiwan.
• Served as Special Master in AAA administered claims involving the Federal Fair Labor Standards Act against owner of multiple restaurant and service operations.
• Served or serving as sole arbitrator, wing or chair in dozens of construction disputes administered by the AAA, ICDR, and in ad hoc proceedings.
• Served or currently serving as sole, wing, or chair arbitrator in numerous insurance related disputes concerning at least the following types of insurance: (1) Health Care Insurance coverage and claims; (2) Officer and Director Errors and Omissions coverage and claims; (3) Life Insurance coverage and claims and disputes between brokers and carriers; (4) Federal Multiple Peril Crop Insurance Common Crop Insurance coverage and claims; (5) Professional Liability coverage and claims; (6) Liability Insurance Policy disputes allocating responsibility for payment of claims among multiple carriers; (7) Workers Compensation Insurance coverage and claims among underwriters and agents; and (8) Reinsurance Policy coverage and claims between carriers (domestic and international).
• Served as chair in dispute administered by the AAA involving the termination of a managing general insurance agency agreement.
• Served as arbitrator (not chair) in multimillion dollar dispute administered by AAA involving sale of U.S. mortgage banking entity.

• Party-nominated arbitrator in international commercial disputes involving multi-national hotel operators administered by ICC and ICDR. Counsel in cross border arbitration and litigation between multi-national hotel operator and hotel developer/owner from 2004-2010.
• Party-nominated arbitrator in companion international commercial disputes involving the Brasilian Oil and Gas Industry administered by ICDR and LCIA.
• Chair of Tribunal in international commercial dispute involving manufacturer/distributor in Brasil administered by ICDR.
• Arbitrator in investment arbitration administered by ICSID, involving claims by Italian mining interests against the Government of the Republic of South Africa.
• Party-nominated arbitrator in dispute administered by ICC between Taiwanese corporation and U.S. based entertainment provider over landing rights for satellite transmissions into the country of Taiwan. Case involved claim for many millions of dollars and was resolved following entry of a partial award on motion for interim relief
• Special Master in Federal Fair Labor Standards Act claims against owner of multiple restaurant and service operations.
• Sole arbitrator, neutral or chair in dozens of construction contract disputes administered by the AAA and ICDR as well as in ad hoc proceedings.
• Arbitrator in multiple cases involving class action claims pursuant to the AAA Supplemental Rules for Class Arbitrations.
• Arbitrator in multimillion-dollar dispute administered by AAA involving sale of U.S. mortgage banking entity that resulted in Award of millions of dollars following more than 10 days of formal hearings.
• Chair of Tribunal in franchise dispute administered by AAA in technology employment field involving claim for millions of dollars resulting in award of substantial damages.
• Chair in ad hoc dispute involving sale of a business with claim for millions of dollars that resulted in an award of no compensation.
• Arbitrator (not chair) in multimillion-dollar dispute pursuant to CPR (non-administered) Rules involving defective piping in a group of multifamily residential buildings in Tampa, Florida pursuant to a settlement agreement reached in a national class action case.
• Sole arbitrator in domestic dispute involving sub-prime mortgages that resulted in an award of damages against loan originator.
• Sole arbitrator in multiple disputes administered by the AAA and ad hoc under the Federal Multiple Peril Crop Insurance Common Crop Insurance Policy.
• Chair of Tribunal in dispute administered by the AAA involving the termination of a managing general agency agreement that resulted in award of millions of dollars.
• Arbitrator in dispute between harbor pilot and harbor pilot association involving termination of the pilot that resulted in damage award in favor of the pilot.
